IMPORTANT AGE REQUIREMENT
As a customer, you must be 21 years or older to use Hala-GH services. Valid Ghana Card required for identity verification.
The following terms and conditions (hereinafter referred to as the "Terms") as updated from time to time, are applicable to all Hala-GH Products unless clearly stated otherwise. These Terms as well as Hala-GH privacy policy (the "Privacy Policy") as updated from time to time, are explicitly incorporated into any applicable agreements ("Agreement"). You ("You" or "Your") should therefore read these Terms together with any applicable Agreement and the Privacy Policy. By using Hala-GH services, you accept these Terms and the Privacy Policy. Customers with device financing agreements have separate personalized credit agreements provided through the mobile application. At Hala-GH we take the privacy of our users and their data very seriously.

1. DefinitionsThese Terms use certain capitalised terms that are also used in Your Agreement. Any capitalised terms that are used in these Terms and not otherwise defined have the same meaning as in the Agreement. For example, terms such as Product, Initial Payment, Credit Payment and Total Payment have the same meaning when they are used in these Terms and in Your Agreement. These Terms also have the following additional defined terms:
  • "Account" means Your Hala-GH account. For customers, the Account is used for managing installment plans and making payments of Initial Payment and Credit Payments. For agents, the Account is used for managing all agent activities including customer onboarding and commission withdrawals.
  • "Additional Product" means any follow-on or upgrade product and/or service that is purchased by You.
  • "Gateway Product" means the Product initially purchased by You which may inform your eligibility to purchase one or more Additional Products.
  • "Product" means the product and/or service purchased from Hala-GH under the Agreement.
2. KYC and Identity Verification Requirements
Mandatory Identity Verification
All users must complete Know Your Customer (KYC) verification to access financial services, as required by Ghana's Anti-Money Laundering Act, 2020 (Act 1044) and Bank of Ghana regulations.
Minimum Age RequirementCustomers must be 21 years or older to use Hala-GH services. This age requirement is verified during the KYC process.Required Documents

  2. Clear photographs of Ghana Card (front and back)
  3. Selfie photograph for biometric matching and liveness verification
Verification Process
  • Verification is performed through automated systems and manual review
  • You cannot access financial services without completing KYC verification
Important: Consequences of False Information
Providing false information during KYC verification may result in permanent account ban and legal action. All KYC data is retained for a minimum of 5 years after account closure as required by law.
3. Guarantor InformationFor installment plans, Hala-GH requires guarantor information to secure the financial arrangement.Information Collected

  • Guarantor's phone number
  • Relationship to customer
Data RetentionGuarantor information is retained for the duration of the installment plan plus 5 years for regulatory compliance purposes. This data cannot be deleted during the retention period as required by financial services regulations.
4. The credit paymentYou agree to pay the applicable Credit Payment by the required date (or in advance at Your choosing) and You agree that the applicable Credit Charge, shall be applied toward Your Hala-GH outstanding balance, until You have paid the Total Payment within the period as set out in the Agreement. Further, You agree that Your Credit Charge may change if You purchase Additional Products. The Credit Charge is non-refundable under any circumstance, including upon return of the Product pursuant to paragraph 17 (Return of Product).
5. Mode of paymentThe Initial Payment and all applicable Credit Payments towards purchase of the Product and/or any Additional Product shall be made through Hala mobile app or dedicated USSD.
Important Notice
No payments by cash will be accepted by Hala nor should they be made under any circumstances for the purchase of any Product or the payment of the Credit Payment. Please inform Hala-GH customer service or email contact@halagh.com immediately if You are requested to make any cash payment or otherwise feel if you have been given wrong, misleading or potentially fraudulent information by any employee or agent of Hala-GH.
6. Promotion/OffersBy reason of your purchase of the Product, You may be identified by Hala-GH as eligible for various promotions and offers (including but not limited to airtime and data bundles). You will receive an SMS or WhatsApp notification informing You of the available promotions and the applicable terms and conditions. Those terms and conditions will be supplemental and subject to the Agreement and these Terms. Hala reserves the right to amend or vary the terms and conditions relating to such promotions/ offers. You may choose to opt out of receiving such promotions and offers by emailing contact@halagh.com or contacting Hala Customer Services.
7. Product deactivation & credit reportingIf You fail to fulfil your contractual obligations including keeping current on your Credit Payments, Hala-GH may deactivate your Product (including by exercising a seller's lien as applicable under this credit sale arrangement) until you become current again in your Credit Payments. This could require the payment of more than one Credit Payment in order to unblock your Account.If you fail to keep current on the Credit Payments for the Product, your credit history may be reported to a credit reference bureau and may not be eligible for Additional Products and services from Hala GH.
8. Additional productsOnce You finalize payment of the Gateway Product with a good credit performance, You will then qualify to apply for an Additional Product. For the avoidance of doubt, the Additional Product can be another Product, or digital financial services such e-vouchers or any other product that Hala-GH is offering as an Additional Product.Where you successfully purchase an Additional Product, You agree that such Additional Product will be subject to the applicable terms and conditions of such Additional Product and where applicable, these Terms. For the purposes of these Terms, the term Product will include an Additional Product. If you fail to keep current on the Credit Payment for such Additional Product, Hala-GH may deactivate your Additional Product until you become current again in your Credit Payments. This could require the payment of more than one Credit Payment to unblock your Account.
9. Agent Terms and Conditions
For Hala-GH Agents and Store Managers
The following terms apply specifically to users registered as Agents or Store Managers on the Hala-GH platform.
9.1 Eligibility Requirements
  • Valid Ghana Card required
  • Must pass identity verification (KYC)
  • Active status maintained through regular activity and compliance
9.2 Commissions and Payments
  • Commission rates are set per device model and may vary
  • Commissions are earned upon successful device activation by customer
  • 24-hour pending period before commission confirmation
  • Withdrawals processed via secure payment gateway supporting MTN Mobile Money, Vodafone Cash, and AirtelTigo Money
  • Minimum withdrawal thresholds apply as set by platform settings
9.3 Agent Code of Conduct
  • Agents must provide accurate customer information during onboarding
  • Prohibition on fraudulent activities, misrepresentation, or deceptive practices
  • Must verify customer identity and eligibility before device assignment
  • Maintain professional conduct with customers at all times
9.4 Agent Responsibilities
  • Device setup and installation as trained by Hala-GH
  • Compliance with all platform policies and regulatory requirements
Violations and Consequences
Violations of the Agent Code of Conduct may result in account suspension, termination, forfeiture of pending commissions, and/or legal action. Hala-GH reserves the right to investigate any suspicious activity and take appropriate action.
9.5 Account Deletion and Termination
Agent Right to Delete Account
Agents may request permanent deletion of their Hala-GH account at any time, subject to the fulfillment of all outstanding obligations and the conditions outlined in this section.
Prerequisites for Account Deletion:Before you can delete your agent account, you must:
  1. Complete all pending onboardings: All customer onboarding processes that are in progress must be completed or properly cancelled. You cannot delete your account while customer onboardings are pending.
  2. Withdraw all commissions: You must withdraw all available commission balances from your account. Any commissions that remain unwithdrawn at the time of account deletion will be forfeited and cannot be recovered.
Account Deletion Process:The account deletion process requires the following steps:
  1. Navigate to account deletion in the agent app settings
  2. Review the cautionary message regarding the permanence of deletion
  3. Confirm that all prerequisites have been met:
    • All pending onboardings must be completed
    • All commissions must be withdrawn
    • This will permanently delete your account and data
  4. Enter your password to confirm your identity and authorize the deletion
  5. Click the final delete button to permanently remove your account
Important Warning - Irreversible Action
Account deletion is permanent and irreversible. Once your account is deleted:
  • You will lose access to your agent account immediately
  • Your account data will be permanently deleted (except data retained for regulatory compliance)
  • You will not be able to recover your account, history, or any unwithdrawn commissions
  • You will need to create a new account and complete KYC verification again if you wish to rejoin as an agent in the future
Outstanding Obligations:You acknowledge and agree that:
  • All outstanding obligations must be resolved before account deletion
  • Any disputes or issues related to customer onboarding must be resolved
  • Account deletion does not release you from any liabilities incurred during your time as an agent
  • Hala-GH reserves the right to deny account deletion requests if there are unresolved disputes, investigations, or outstanding obligations
Data Retention After Deletion:
As detailed in the Privacy Policy, certain data will be retained after account deletion to comply with regulatory requirements, including:
  • KYC and identity verification data (minimum 5 years)
  • Financial transaction and commission records (5 years)
  • Customer onboarding records (per regulatory requirements)
This retention is required by Ghana's Anti-Money Laundering Act, 2020 (Act 1044), Bank of Ghana regulations, and other applicable financial services laws.

Hala-GH's Right to Terminate:
Hala-GH reserves the right to suspend or terminate agent accounts at any time for:
  • Violations of the Agent Code of Conduct (Section 9.3)
  • Fraudulent activities or misrepresentation
  • Non-compliance with platform policies or regulatory requirements
  • Other violations of these Terms and Conditions
In cases of account termination by Hala-GH due to violations, commissions may be forfeited, and legal action may be pursued.

10. Hala-GH administrative right over your productYou understand that Hala-GH shall have certain administration rights over your Product which will allow Hala-GH to restrict usage of and potentially disable the Product (including by exercising a seller's lien as applicable under this credit sale arrangement) if your Credit Payment is not paid or your Account is otherwise in arrears during the payment period.
Important Warning
You agree not to attempt to alter the administration rights granted to Hala-GH on the Product and any attempt to do so could void the warranty of the Product and violate the intellectual property rights of Hala-GH and the relevant Product manufacturer.
11. Intended useAll Products should be used solely in accordance with any applicable manufacturer instructions and Product end-user license agreements (where applicable). Your Product must be maintained in proper repair and working condition in order to receive any applicable refund on your Product. Improper use or maintenance of the Product may result in forfeiture of the warranty.
12. Contact informationYou consent that Hala-GH will send electronic communications to the contact information which You provide in the Agreement. You are solely responsible for the accuracy of such information and must ensure that all contact information provided to Hala-GH is complete and accurate in order to allow Hala to contact You or the Alternative Contact Person during reasonable hours regarding Your Account. You agree that it shall be Your sole responsibility to keep Your contact information current and You will be deemed to have received any notice issued based on the contact information provided by You to Hala-GH, whether or not You actually receive the information or not.
13. Lost, stolen or damaged productsYou understand that Hala-GH is not responsible for the recovery of lost or stolen Products and does not track lost or stolen Products. If your Product is lost or stolen at any point, during or after the term of the Agreement, it is your responsibility to report the matter to the appropriate police authorities. You further agree that even if the Product gets lost, stolen or damaged while out-of-warranty, you will be responsible for paying the applicable Credit Payment and the Total Payment for your Product. Where you purchase the Product with an insurance cover and the Product is thereafter lost or stolen, then provided you meet Hala-GH's insurance claim qualification criteria you will be eligible for a replacement '2nd life product' (subject to any other applicable terms and conditions).
14. Ownership of the productYou understand that You shall take ownership of the Product at purchase under a credit sale arrangement but that Hala-GH and/or the Product manufacturer (as applicable) shall at all times retain ownership to all of its intellectual property (whether registered or not) (the "Product Intellectual Property") that is used to operate the Product and the data generated therefrom, in both cases even after the Total Payment is paid.
Prohibited Actions
You must not tamper, open, alter the administration rights, reverse engineer, misappropriate or modify and/or use the Product Intellectual Property in any other way not authorised by Hala-GH and/or the Product manufacturer (as applicable) or aid any third party to do the same. Any contravention of this condition will result in forfeiture of the Product warranty, void any right to a refund and result in a fundamental breach of the Agreement.
15. AssignmentYou agree that You will not transfer or assign any rights or obligations under the Agreement without the prior written consent of Hala-GH. Hala-GH has the right to transfer or assign the Agreement or any right or obligation under the Agreement at any time. Further, You consent to such assignment by Hala-GH of any rights or obligations therein, provided that such transfer does not alter my rights and obligations under the Agreement to Your detriment.
16. Inspection of Hala-GHYou agree to grant to Hala-GH, its employees or agents all reasonable facilities and opportunity for the inspection of the Product at any time, subject to reasonable notice, including but not limited to with respect to any repair services or for the purpose of investigating any fraudulent uses of the Product during the term of the Agreement.
17. Return of productYou may return Your Product to any Hala-GH authorized retail store at any time during the Term of the Agreement, provided that You do not have an existing Hala-GH Product or, Your Product is not being used as collateral for a loan elsewhere. Your Product will be evaluated, and You may:
  • Be eligible for a refund of Your Initial Payment either in full or in part depending on the evaluated condition of Your Product; and
  • Be released from Your Remaining Credit Payment obligation under the Agreement.
18. WarrantiesHala-GH will repair or replace a Product, in accordance with the warranty terms provided by the Product manufacturer. The warranty is valid only if the Product is used as instructed and is not tampered with, opened, modified and/or used in other ways not authorised by Hala-GH, the Agreement and these Terms. The warranty period is as set out in the instruction manual for the relevant Product.Hala-GH reserves the right not to accept any Product that is returned under warranty. Approval from Hala-GH's customer service is required before a Product can be returned to an Hala-GH service center or shop for repair or replacement. Once approval has been obtained, You should return Your faulty Product to the nearest Hala-GH authorized shop or authorized service center for repairs or replacement.
19. Additional provisions
19.1 Product ActivationHala-GH will ensure the Product is activated once the Initial Payment is received and, thereafter, whenever Your Account has a positive credit balance. Hala shall not accept responsibility if a Product does not receive credit due to third party system or network outages which result in a failure for a Product to receive credits.
19.2 End Billing when Total Payment is PaidHala-GH will complete billing for the Product and end further Credit Payment requirements once the Total Payment of the Product is paid. Hala-GH reserves the right to reactivate and maintain the module and billing for any Additional Products that You may purchase.
19.3 Product InstallationHala-GH shall train its agents on how to install the Products and shall certify that the Products are in good working condition upon installation with confirmation by You. Where You choose to install the Product on Your own without the assistance of an Hala-GH certified installer, You shall be liable for any negligent handling which leads to the failure of the Product to perform as expected.
20. Third-party chargesYou acknowledge that from time to time You may communicate with Hala GH via USSD code in order to perform certain transactions on Your Account. You agree that such communication is made possible by third-party service providers and is subject to third-party charges. These third-party charges are separate from the Credit Charge and are paid by You directly to the third-party service provider whether disclosed by the third-party service provider in advance or otherwise. You agree that all charges payable to third-party service providers, including all applicable taxes, are Your sole responsibility.
21. Sim locked productTo the extent this paragraph is applicable to You, certain Products may be SIM-locked to a designated mobile network operator (MNO) in partnership with Hala. The SIM Lock configuration limits the full use of the Product to the MNO's network for the duration of the Offer Period (typically the duration within which Your Total Payment remains outstanding or a period not exceeding twelve (12) months from the date You purchase the Product, whichever is earlier).
SIM Lock Terms
  • Product remains SIM-Locked for the Offer Period
  • MNO SIM must be in the Primary Port for full functionality
  • Secondary Port SIM cards limited to voice and SMS only
  • No tampering with software/hardware during Offer Period
  • Free to use any MNO SIM after Offer Period ends
22. General provisionsNo waiver of these Terms by Hala-GH will be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure of Hala to assert a right or provision under these Terms will not constitute a waiver of such right or provision. If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision will be modified to reflect the Hala GH's and Your intention or eliminated to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect. These Terms will be governed and construed in accordance with the applicable laws of Your domicile. Any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by, construed and determined in accordance with the applicable law of Your domicile.
